Wittwer v. Burcar et al., Court File No. C1-00-600801 (St. Louis County). Obtained $1.565 million settlement for widow in wrongful death claim. Leveraged result by moving Court for declaratory judgment on inapplicability of rental vehicle defendant’s defense claiming that it was entitled to vicarious liability cap of $100,000 pursuant to Minn. Stat. § 65B.49, subd. 5a(i)(2). Rental industry subsequently successfully lobbied to amend state statute and further lobbied the US Congress to limit rental vehicle vicarious liability.
